Depp-Heard trial verdict condemned as ‘toxic catastrophe’ for women | Johnny Depp

One day after Johnny Depp widely won her libel lawsuit against Amber Heard, Heard’s lead attorney, said ‘unbalanced’ social media posts about the trial turned the courtroom into a ‘zoo’ and influenced the jury’s verdict .

Speaking to NBC, Elaine Bredehoft said the verdict sent “a horrible message”, adding that she believed the seven-member jury was unable to escape the social media frenzy that enveloped the six-week trial.

“How can you [escape it]she asked. “They were going home every night. They have families. Families are on social media. We had a 10-day break in the middle because of the court conference. they were not influenced by it.

“It’s like the Roman Coliseum, you know? How they saw this whole affair. I was against the cameras in the courtroom and I said it publicly and I objected to it because of the sensitive nature of it. But that made it a zoo.

Jurors found that Depp and Heard defamed each other. But they basically came out in favor of Depp, with all three of his claims backed up by one of Heard’s three claims. The parties received $10.35 million and $2 million, respectively.

Heard’s Lawyers said they would appeal.

The outcry built on Thursday. Tarana Burke, co-founder of the #MeToo movement, said in a statement“The manner in which #MeToo was co-opted and manipulated in the Johnny Depp v Amber Heard trial is a toxic disaster and one of the greatest vilifications of the movement we have ever seen.”

Bredehoft said Heard told her she felt like she let women down.

“One of the first things she said was, ‘I’m so sorry for all those women. This is a setback for all women inside and outside the courtroom. She feels the burden.

Some experts in the field of sexual and domestic violence said the verdict should be a wake-up call for women to work harder in a system that does not guarantee equal protection.

“It’s a symptom of a culture that has oppressed women since its founding,” Wendy Murphy, a former sex crimes prosecutor, told The Guardian. “This is the first proof that women need full equality before the law in this country. Without it, we get absurd verdicts like this.

Murphy said Heard had been denied equal protection because the U.S. constitution had denied it to women since 1868, when the 14th amendment guaranteed “equal protection of the laws” without explicitly mentioning women. It was not until 1971 that a Supreme Court decision, Reed versus Reedestablished that the different treatment of men and women was unconstitutional.

“Without constitutional equality, laws need not be applied equally on behalf of any woman by any court,” Murphy said. “But the idea that this verdict is going to set us back, that women are going to shut up, that women are scared, that’s bullshit.

“Women will respond to this with a vengeance. We will stand up, we will talk, we will organize and we will respond.

Lisa Bloom, a prominent lawyer, pointed out that one of the charges against Heard concerned the headline of the Washington Post article at issue – “I spoke out against sexual violence – and I faced to the wrath of our culture. This must change” – which Heard did not write.

Murphy said the ‘irrational nature’ of the verdict – in which jurors upheld Heard’s claim that Depp defamed her when her attorney described her domestic violence allegation as ‘an ambush, a hoax’ – will help at any call.

“Maybe it was an irrational jury,” she said, “but it’s not unusual for a jury to reach a verdict where they feel like they’re giving both sides a little bit.

“But the fact that the jury [first] returned without any damage and were sent back to the jury room is powerful evidence that it was just a stupid jury. It doesn’t matter what they clung to. The question is why was the jury unable to be rational?

“Why couldn’t they see what was right in front of them and instead were subjected to Depp’s defense warping tactics that allowed the evidence to pass in front of them?”
