Amber Heard’s legal team just filed a new countersuit related to the Johnny Depp case
We knew the legal drama between Amber Heard and Johnny Depp wasn’t over yet. Both sides have it Appealed against their respective judgments in defamation cases. However, this was not the only legal battle Heard found himself in after the loss in court. Heard was sued by his insurance company
New York Marine & General Insurance Co. previously insured Amber Heard for $1 million, but the company filed a lawsuit. Verdict in defamation case, claims it does not have to pay Hurd’s defense costs or the monetary award it is asked to pay. The company claimed that because Heard was found to have committed an “intentional act” in defamation of Johnny Depp, it should not be paid. California law allows insurance companies to opt out of paying if the insured party’s violation is viewed as willful.
However, Amber Heard thinks otherwise. TMZ Reports say that Heard has now filed a countersuit against the insurance company, claiming that her contract with them for the $1 million policy specifically states that it will pay under any circumstances and that the company is now going back on that contract.
If the insurance company contract promises to pay under any circumstances, that is Potential breach of contract, which is a count under which Heard is suing. Now a judge will be tasked with deciding who is responsible for what.
Even a $1 million insurance policy is only going to scratch the surface of what Amber is Heard is currently expected to pay her ex-husband Johnny Depp. The judgment against him is more than $10 million, and that doesn’t include the cost of his own legal fees. If Heard has to pay all the money, the insurance policy alone won’t do the job.
Having said that if Hard is successful on appeal, we could see the compensation award significantly reduced, if not eliminated entirely, so fighting for this $1 million is probably worth the time. After an appeal by Heard’s legal team, the actress was awarded $2 million in damages in her own defamation suit. Johnny Depp’s side filed their own appealSo that award is under review.
Given the changing pace of the legal system it is impossible to know when these various battles will be decided. If the defamation appeal is handled first, and it goes the hard way, we may even see this insurance company’s case dropped, if the insurance payout is contested. What is clear is that Amber Heard is still going to spend a lot of time in the courtroom for the foreseeable future.
